These Terms & Conditions apply to purchases made through the Midnight Apparel website and any related payment links. By using our site or placing an order, you agree to these terms.

1. About Midnight Apparel

Midnight Apparel is a Christian-owned apparel brand operating in New South Wales, Australia. We aim to do business with clarity, integrity, and respect.

2. Orders

By placing an order, you confirm your details are correct, including shipping address and contact information. We may cancel an order if payment is not authorised, stock is unavailable, or we reasonably suspect fraudulent activity. An order is confirmed once payment is successfully processed and you receive an order confirmation.

3. Pricing and Payment

Prices are shown in AUD unless stated otherwise. We may update prices at any time. Price changes do not affect orders already paid for. Payments are processed securely through our payment providers (e.g. Stripe). We do not store full card details.

4. Product Information

We do our best to show products accurately, however: Colours may vary between screens and lighting. Measurements and fit guidance are approximate. Minor variations can occur between production runs, especially for limited releases.

5. Limited Releases

Some products are limited edition and may not be restocked once sold out. If a product is limited, it will be stated on the product page.

6. Shipping and Delivery

Shipping costs are shown at checkout and are non-refundable.

Delivery timeframes are estimates only and can be affected by carriers, peak seasons, customs, weather, or events outside our control.

Once an order is marked delivered by the carrier, responsibility transfers to the customer. If a parcel is missing, contact us and we will assist with the carrier process.

7. Returns, Refunds, and Faults

No change-of-mind returns

We do not offer returns or refunds for change of mind, wrong size selection, or preference. Please choose carefully and use the size guide before ordering. Faulty or incorrect items We will provide a remedy if: The item is faulty, damaged, or not as described, or You received the wrong item. If there is an issue, contact us within a reasonable time with your order number and photos where relevant.

Australian Consumer Law

Nothing in these Terms limits your rights under Australian Consumer Law. If a product has a major failure, you may be entitled to a replacement or refund. For minor failures, we may repair, replace, or provide another remedy as required by law.

Shipping refunds

Shipping costs are not refunded, except where required by Australian Consumer Law.

8. Sizing

Sizing is the customer’s responsibility. If you’re unsure, contact us before purchasing and we’ll help guide you, but we cannot guarantee fit.

9. Intellectual Property

All designs, logos, artwork, product names, images, and website content are owned by Midnight Apparel (or licensed to us). You may not copy, reproduce, sell, or distribute our designs or content without written permission.

10. Promotions and Discount Codes

Discount codes must be applied at checkout and cannot be added after purchase.

We may change or end promotions at any time.

Codes may not apply to limited releases unless stated.

11. Community Standards

We reserve the right to refuse service or cancel orders where there is abuse, harassment, threats, or misuse of our systems.

12. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect or consequential loss related to your purchase or use of our products. Our liability is limited to the amount paid for the product in question.
This does not exclude any rights you have under Australian Consumer Law.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy. We collect only what we need to process orders and provide customer support.

14. Changes to These Terms

We may update these Terms & Conditions from time to time. The latest version will always be available on our website.

15. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Any disputes will be handled in the courts of NSW.
